A Plan Designed for Compliance
The Self-Insured Medical Reimbursement Plan (SIMRP) is designed to operate under applicable provisions of the Internal Revenue Code, including Sections 105, 106, 125, and 213(d), along with applicable Treasury Regulations and federal requirements such as ERISA, HIPAA, the ADA, and ACA-related guidance. Plan design, administration, reimbursements, and eligibility must follow the provider’s plan documents and applicable nondiscrimination rules.
Medical Services Are a Key Component
The SIMRP wellness program is designed to work alongside an ACA-compliant medical plan as part of an integrated Section 105 plan structure.
Pre-Tax Plan Contributions
When properly structured through a Section 125 Cafeteria Plan, eligible employee contributions for accident or health coverage may be made on a pre-tax basis. IRS Chief Counsel Memorandum 201703013 Dated: 1/20/2017 states “The value of employer-provided wellness program coverage that provides medical care as de ned under §213(d) is generally excluded from gross income under §106(a)...”.
Medical Reimbursements
The memorandum goes on to state, “...reimbursements for quali ed medical care expenses, as de ned under §213(d), may generally be excluded from an employee’s gross income under §105(b).” Note however — payments, rewards, incentives, or bene ts that are not reimbursements for actual medical care expenses may be taxable.
Reimbursement Allowances
Allowable reimbursement amounts are determined by the plan documents and applicable IRS rules governing Sections 105, 106, 125, and 213(d). Reimbursements must be limited to quali ed medical expenses and administered in accordance with applicable nondiscrimination, substantiation, and plan compliance requirements.
